2007-06-22 / Privacy of personal messages In 2003 a teenager was sexually assaulted by another student of middle school who later was convicted in the case T.V. versus Union Township Board of Education. T.V. blames the school for the emotional distress caused to the girl as a result of the assault; however her state of mind has been turned to a question. The Union Township Board of Education expects Facebook and MySpace for giving access to her personal blog postings and messages in case to address her claim of emotional distress. So now everyone is looking impatiently for MySpace and Facebook response. In courts there are a lot of discussions on privacy issues regarding access to private blog postings and messages, and arguments go on with this specific case. Some people prefer to consider these messages on social networking sites in the same way as emails sent via AOL or Yahoo; others manifest that there should not be any access because of direct violation of privacy. There are complicated facts in this very case, but T.V. signed a waiver allowing for her private information to be accessed, but the subject got sticky when a question on her Facebook and MySpace accounts can be included to this waiver. As the privacy issue is not yet resolved, MySpace and Facebook have to react on the demands for T.V.’s private information. Consequences of this case could greatly influence on treatment of social networks in comparison to other communicative portals as well as email and telephones.
